Why Prevailing Wage Is in the News"},"content":{"rendered":"<p>Among the many laws and <a href=\"https:\/\/www.foundationsoft.com\/learn\/10-construction-payroll-features\/\">regulations in construction<\/a>, sometimes it\u2019s easy to get lost in the legal lingo. The Davis-Bacon Act (or \u201cprevailing wage\u201d law) is one that many contractors are familiar with, but with the constant updates, revisions and repeals occurring from state to state, it\u2019s difficult to stay informed.<\/p>\n<p>For example, in case you didn&#8217;t know, the <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/government-contracts\/construction\/rulemaking-davis-bacon\">Department of Labor<\/a> published in the Federal Register the final rule, \u201cUpdating the Davis-Bacon and Related Acts Regulations&#8221;, on August 23, 2023. The final rule took effect on October 23, 2023.<\/p>\n<p>Are <em>you<\/em> keeping up with the Davis-Bacon Act?<\/p>\n<p>Join us as we sift through the details. Find out where it all started, which states are making changes and why, and where it\u2019s headed in the future.<\/p>\n<a target=\"_blank\" href=\"\/construction-accounting-software-ebook\/\" class=\"blog-cta-image\"><img decoding=\"async\" src=\"\/wp-content\/uploads\/2024\/05\/2024-05-FSL-blog-post-ad-5-ways-ebook.png\" alt=\"eBook Download\" title=\"eBook Download\"><\/a>\n<h3><span class=\"ez-toc-section\" id=\"What_Is_the_Davis-Bacon_Act_In_30_Seconds_or_Less\"><\/span>What Is the Davis-Bacon Act?<br \/>\n(In 30 Seconds or Less)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>At its most basic, the Davis-Bacon Act requires contractors working on federal-government jobs to <a href=\"https:\/\/www.foundationsoft.com\/learn\/construction-payroll-services\/\">pay laborers<\/a> a wage and benefits equal to what other union and non-union shops pay their workers in the same area for more or less the same project. In other words, it\u2019s the wage that \u201cprevails\u201d locally for a given trade or type of work.<\/p>\n<p>People may also refer to the many Davis-Bacon related acts and other legislation that impose prevailing wages. But the Davis-Bacon Act is really one bill, which traces back to the early 20th century.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Where_Did_Davis-Bacon_Come_From\"><\/span>Where Did Davis-Bacon Come From?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Prior to Davis-Bacon, several local laws required a prevailing wage on public-works projects. However, in the 1920s, many grew worried over declining wages and displacement of local workers by migrant laborers. This was Rep. Robert Bacon\u2019s concern when he introduced an early form of the federal bill in 1927. Versions of it failed 13 times, until the Great Depression shifted Washington\u2019s attention to a bill that would control collapsing wages.<\/p>\n<p>The Davis-Bacon Act of 1931 was sponsored by two individuals \u2014 Rep. Bacon and former labor secretary Sen. James Davis. They each felt laborers and mechanics in the construction industry were being hurt by low wages and could be helped when it came to government jobs. Many times these low-paid workers were unskilled, recent immigrants.<\/p>\n<p>The authors of the Act set out to establish a local wage standard, which the U.S. Department of Labor (DOL) would determine, that contractors must pay workers on public projects. This, they hoped, would make it fair to everyone \u2014 the contractors, the government and the workers. Contractors could place their bids on jobs competitively, knowing they&#8217;d all have to pay their workers the same rate.<\/p>\n<p>Since then, numerous amendments and related laws have expanded prevailing wage legislation.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Where_Is_Davis-Bacon_Today\"><\/span>Where Is Davis-Bacon Today?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Today, according to the DOL, \u201cThe Davis-Bacon and Related Acts apply to contractors and subcontractors performing on federally funded or assisted contracts in excess of $2,000 for the construction, alteration, or repair (including painting and decorating) of public buildings or public works.\u201d<a title=\"\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<p>Trainees and apprentices may receive less than the predetermined rates, as long as they\u2019re in a DOL program. Additionally, employers must pay any employee working on a contract that exceeds $100,000 one and a half times the employee&#8217;s basic rate for all hours above 40 worked on a prevailing wage job in that week.<\/p>\n<div class=\"gdlr-stunning-text-ux gdlr-ux\">\n<div class=\"gdlr-stunning-text-item type-normal with-padding \" style=\"background-color:#f3f3f3;\" >\n<div class=\"stunning-text-caption\" style=\"color: #a0a0a0\" >Contractors and workers can find out the wage determinations by visiting the government-run website <a href=\"https:\/\/www.wdol.gov\/dba.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Wage Determinations OnLine<\/a> and entering the proper criteria.<\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<p>Under the big umbrella of the Davis-Bacon Act are smaller umbrellas \u2014 sets of state laws referred to as the Little Davis-Bacon Act (LDBA) \u2014 that are individualized per state and apply to state-funded projects. When both federal <em>and<\/em> state levels fund projects, which might be the case in some highway projects, both laws would apply, but the contractor would comply with whichever law is most stringent.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Whats_Next_for_Prevailing_Wage\"><\/span>What\u2019s Next for Prevailing Wage?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Not everyone is in agreement that prevailing wage laws are positive for the health of the industry. In 2017, Arkansas, Kentucky and Wisconsin joined 21 other states without a prevailing wage when it repealed its LDBA.<a title=\"\" href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Michigan repealed their own such legislation in 2018, bringing the total to 24 states without prevailing wage laws.<\/p>\n<p>At the federal level, Rep. Steve King from Iowa is working on repealing the Davis-Bacon Act. The U.S. House of Representatives introduced King\u2019s H.R. 743 in January 2017 as a bill to repeal the Davis-Bacon Act completely. Sen. Mike Lee introduced its companion bill in the Senate. If enacted, H.R. 743 would make any reference in any law to a wage requirement of the Davis-Bacon Act null and void.<a title=\"\" href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>King and Lee expressed concern that the Davis-Bacon Act affects taxpayers and federal contractors negatively, with prevailing wages costing 20-25% more. Lee said in a press release that contractors would have \u201cthe ability to hire more workers of all skill level\u201d if Congress were to repeal the act.<a title=\"\" href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> Many proponents of the repeal also believe that the prevailing wage raises construction costs and therefore raises taxpayer dollars. According to a 2018 study by the University of Kentucky Center for Business and Economic Research (CBER) total construction costs for West Virginia public schools decreased by approximately 7 percent.<a title=\"\" href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>However, there are also groups debating that theory. A study conducted in Ohio, \u201cThe Economic, Fiscal, and Social Effects of Ohio\u2019s Prevailing Wage Law,\u201d concluded that there is no increase in construction costs due to prevailing wages: \u201cOver the past 16 years, 76% of the studies examining the effect of prevailing wage laws on construction costs find no impact, including 82% of the studies focused on public school construction.\u201d The authors also state that repealing prevailing wage will not only decrease the income of construction workers but that it will increase poverty and reliance on public assistance.<a title=\"\" href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>In the meantime, a healthy debate continues.<\/p>\n<a target=\"_blank\" href=\"\/learn\/#schedule-a-live-demo\" class=\"blog-cta-image\"><img decoding=\"async\" src=\"\/wp-content\/uploads\/2024\/03\/FSL-blog-post-ad-see-how.png\" alt=\"Get a Demo\" title=\"Get a Demo\"><\/a>\n<h3><span class=\"ez-toc-section\" id=\"Stay_Tuned\"><\/span>Stay Tuned<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>For almost a hundred years, legislatures have expanded, modified and in some cases repealed the Davis-Bacon Act and LDBA. Though we briefly mentioned recent state legislation, if the history of prevailing wage in America has shown us anything, it\u2019s that we can expect many more changes to come.
